AGREEMENT TO OUR LEGAL TERMS

We are Purely Concrete Inc. ("Company," "we," "us," or "our"). We operate the website https://purelyconcrete.com (the "Site") and provide residential concrete services, including driveways, patios, walkways, slabs, repairs, concrete replacement, and related concrete services (collectively, the "Services").

These Terms of Service ("Terms") form a legally binding agreement between you, whether personally or on behalf of an entity ("you"), and Purely Concrete Inc. regarding your access to and use of the Site and Services. By accessing the Site, submitting a request, scheduling an estimate, communicating with us, or using our Services, you agree that you have read, understood, and agree to be bound by these Terms. If you do not agree with these Terms, you must discontinue use of the Site and Services.

We may update these Terms from time to time. We will indicate any changes by updating the "Last Updated" date above. Your continued use of the Site or Services after updated Terms are posted means you accept the updated Terms.

The Site and Services are intended for users who are at least 18 years old.

1. OUR SERVICES

Purely Concrete Inc. provides residential concrete services in Orange County and LA County, California. Our contractor license is License C-8 #1144184.

Information on the Site is provided for general informational purposes only. Content on the Site, including descriptions of services, examples of prior work, photos, pricing references, timelines, or project information, does not create a binding estimate, quote, warranty, or contract.

All estimates, project scopes, timelines, pricing, materials, finishes, warranty terms, and service obligations are subject to inspection, site conditions, written approval, and any separate written estimate, proposal, invoice, or agreement provided by Purely Concrete Inc.

2. ESTIMATES, PROJECTS, AND SITE CONDITIONS

Customers may request estimates through the Site or by phone. Estimates may depend on project size, site access, demolition needs, drainage, soil conditions, existing concrete, permits, material availability, weather, and other factors.

Concrete work may be affected by conditions outside our control, including weather, curing conditions, ground movement, drainage issues, hidden subsurface conditions, utility conflicts, customer changes, permitting delays, material shortages, and access limitations. Project timelines are estimates only unless expressly stated otherwise in a written agreement.

Concrete is a natural and site-sensitive material. Color, texture, finish, curing, minor surface variations, and cracking may vary depending on conditions. Any warranty or workmanship commitment is limited to the specific written warranty, estimate, proposal, or contract provided by Purely Concrete Inc.

3. PAYMENTS

Purely Concrete Inc. does not currently accept payments through the Site. Payment terms, deposits, balances, accepted payment methods, and due dates will be stated in the applicable written estimate, proposal, invoice, or contract.

4. INTELLECTUAL PROPERTY RIGHTS

The Site, including its text, graphics, photos, designs, logos, service descriptions, and other content, is owned by or licensed to Purely Concrete Inc. and is protected by copyright, trademark, and other applicable laws.

You may access and use the Site for personal, non-commercial purposes, including reviewing our services or requesting an estimate. You may not copy, reproduce, distribute, modify, publicly display, or use our Site content, name, logo, photos, or branding for commercial purposes without our prior written permission.

5. CUSTOMER COMMUNICATIONS AND SUBMISSIONS

When you contact us, submit a form, call us, email us, or otherwise communicate with us, you agree to provide accurate and current information. You are responsible for the information you submit.

Customers do not create accounts on the Site, and the Site does not generally allow public posting of user-generated content. If you send us questions, comments, reviews, feedback, testimonials, photos, or other materials, you represent that you have the right to provide them and that they do not violate the rights of any third party.

Unless otherwise agreed in writing, you grant Purely Concrete Inc. permission to use feedback, reviews, testimonials, and non-confidential communications for lawful business purposes. We will handle personal information in accordance with our Privacy Policy.

6. PROHIBITED ACTIVITIES

You agree not to use the Site or Services to:

- Violate any applicable law or regulation.

- Submit false, misleading, or fraudulent information.

- Interfere with the security or operation of the Site.

- Attempt to access systems, data, or areas of the Site without authorization.

- Use automated tools, scraping, bots, or similar methods to collect Site content without permission.

- Upload or transmit malware, harmful code, spam, or disruptive materials.

- Impersonate another person or misrepresent your relationship with any person or entity.

- Use the Site or our content to compete with us or commercially exploit our materials without permission.

7. PRIVACY POLICY

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing with subcontractors or service providers in support of customer service, scheduling, estimates, operations, or related business support is permitted. Text messaging originator opt-in data and consent will not be shared with any third parties for marketing purposes.

8. SMS TEXT MESSAGING

Purely Concrete Inc. uses SMS text messaging to communicate with customers and prospective customers who contact us, request an estimate, submit a website form, call us, or otherwise consent to receive text messages.

Messages may include conversational, transactional, and informational updates such as estimate follow-ups, appointment scheduling, appointment reminders, missed call text backs, project coordination, customer support, and service-related updates.

With your consent, Purely Concrete Inc. may also send occasional marketing text messages, including seasonal promotions, special offers, service updates, and related promotional communications. Consent to receive marketing text messages is not a condition of purchasing any goods or services from Purely Concrete Inc.

Message frequency varies. Message and data rates may apply. Carriers are not liable for delayed or undelivered messages.

To opt out, reply STOP to any text message from us. After you send STOP, we may send a confirmation message that you have been unsubscribed. After that, you will no longer receive SMS messages from us unless you opt in again.

By opting in to receive SMS messages from Purely Concrete Inc., you represent that you are the account holder or customary user of the mobile phone number provided and that you consent to receive messages from us at that number.

9. WARRANTY DISCLAIMER

Purely Concrete Inc. offers warranty coverage as stated in the applicable written estimate, proposal, invoice, warranty document, or project agreement. Any warranty is limited to the terms, exclusions, duration, and conditions stated in the written warranty or project documents.

Except as expressly stated in a written agreement from Purely Concrete Inc., the Site and Services are provided on an "as is" and "as available" basis to the fullest extent permitted by law. We do not guarantee that the Site will be uninterrupted, error-free, or free of harmful components.

10. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Purely Concrete Inc. and its directors, officers, employees, agents, subcontractors, and representatives will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from your use of the Site or Services.

Nothing in these Terms limits any rights, remedies, or obligations that cannot be limited under applicable law or under a separate written contract between you and Purely Concrete Inc.

11. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Purely Concrete Inc. and its directors, officers, employees, agents, subcontractors, and representatives from and against any claims, damages, losses, liabilities, costs, or expenses, including reasonable attorneys' fees, arising from your misuse of the Site, your violation of these Terms, your violation of applicable law, or your violation of any third-party rights.

12. MODIFICATIONS AND INTERRUPTIONS

We may update, modify, suspend, or discontinue any part of the Site at any time without notice. We are not responsible for any loss or inconvenience caused by Site downtime, interruptions, errors, or changes to Site content.

13. GOVERNING LAW

These Terms and your use of the Site and Services are governed by the laws of the State of California, without regard to conflict of law principles.

14. DISPUTE RESOLUTION

Before filing any claim, you and Purely Concrete Inc. agree to first attempt to resolve any dispute informally by contacting the other party and allowing a reasonable opportunity to resolve the issue.

Any dispute arising from or relating to these Terms, the Site, or the Services shall be brought in the state or federal courts located in Orange County, California, unless otherwise required by applicable law or a separate written agreement. You agree to the jurisdiction and venue of those courts.

16. ELECTRONIC COMMUNICATIONS

By visiting the Site, submitting forms, sending emails, calling us, texting us, or otherwise communicating with us electronically, you consent to receive electronic communications from us. You agree that electronic communications satisfy any legal requirement that communications be in writing to the fullest extent permitted by law.

17. MISCELLANEOUS

These Terms, together with any policies posted on the Site and any separate written estimate, proposal, invoice, warranty document, or project agreement, constitute the agreement between you and Purely Concrete Inc. regarding the Site and Services, except where a separate written agreement expressly controls.

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be deemed severable and will not affect the validity or enforceability of the remaining provisions.

Our failure to enforce any provision of these Terms does not waive our right to enforce that provision later.
